carpool violation
Several months ago I posted a thread (which I can't find) regarding a ticket I got for a carpool violotion on the Bay Bridge. Welp, I finally had my day in court today and the good news is that all the charges were dropped and I get my $400 back! It's okay to have two people in your GTV in a three person carpool lane!
Thanks to GianniB for the recall pdf and reference to John Hertzman's post. The judge said he had never encountered so much evidence stating that a car was a two seater until today. I had pictures of my glovebox showing the loading info., my owner's manual, and the recall notice.

The GTV is classified as a 2 seater on a badge located on the inside of the glovebox door. It is also indicated in the owner's manual. The reason it's a two seater is that the rear seats don't meet Federal reg's for a rear seat (per the '73 recall that GianniB supplied), so Alfa never installed seat belts and posted the 2 seat loading.
The judge said that in California the number of passengers is determined by manufacturer intent. Therefore, even though the GTV has what looks like rear seats, the intent is that they are not.

Part of the recall campaign involved putting a sticker on the inside leading edge of the rear quarter windows. The inside of the sticker said, in effect, that the rear seats were not to be occupied while the vehicle was in motion. The outside of the sticker commemorated Alfas Trans-Am win in 1970. These stickers are currently listed in this ebay auction.

my 74 has an original sticker in the center of the rear seatback that states that no one should sit there while the vehicle is in motion.
