If the equipment is in place and the car passes without it being operable the point is moot. My MGB-GT had smog equipment in place that was connected but not operating and passed without problem. But it does have to be there, be properly connected, and look right.

I'm not sure at this point where the rolling smog law is since the rolling was stopped; I think it's 1973 and previous that are exempt from smog, but not positive.
